Terms

Terms & Conditions: All contracts with the firm Beads By Lili are upon and subject to the following provisions, to your overriding statutory rights, to the Laws of England and to the exclusive jurisidiction of its Courts.  Terms are subject to alteration in respect of future engagements.

How to Buy:  Its easy to buy items from the Beads by Lili website – just browse through the items and click on the shopping basket to put an item in your basket. You can increase the number of each item you want by clicking and editing the number in the white box next to the shopping basket symbol. Prices are as advertised on the website (and are not presently subject to VAT - so no VAT invoice)  and postage/delivery costs are payable in addition at the rates shown on the website from time to time.  Higher value orders may be sent recorded at no additional cost to you.  We must receive payment of the whole of the price for the goods that you order plus delivery costs before your order can be accepted.  Our subsequent acceptance of your order brings into existence a legally binding contract between us.

Stock: We aim to sell only items in stock and to keep our website up to date.  In the event that we are unable for whatever reason to supply an item, or to the quantity you have selected, we will either issue an immediate partial/ whole refund,  substitute a similar item, or contact you by email to offer you an alternative item without obligation on your part.  Our obligation shall not extend beyond these alternatives.

How to Pay: Our preferred payment method is PayPal through which you can use a credit/debit card but if you wish to pay by cheque or postal order we will email you with details once we have received your order.  Items will be sent only upon clearance of cheques or upon receipt of postal orders.  If a cheque does not clear on first presentation the engagement is automatically cancelled.

Description of Products and Condition:  Due to the nature of handmade products there may be slight difference in size, shape or form of some items.  We make every effort to present the goods accurately but the images on the website are not to scale and variations in computer monitors and browsers sometimes mean that images vary slightly from the product picture.  Batch colours of beads may also vary.   Sizes & measures are approximate and whilst we use reasonable endeavours to exercise quality control of items prior to dispatch we do not guarantee that all items in the pack are 100% perfect.  Also in the case of surface dyed beads,  other dyed products or metal products which you intend for wear on clothing or next to the skin, you agree to test these products for suitability first, both for the fastness of the dye and for any allergic reaction.  In connection with the circumstances described in this paragraph you agree that the liability of Beads By Lili shall in no circumstances exceed the invoice price of the goods.

Goods are carefully wrapped to ensure so far as possible that they arrive safe and undamaged.  You agree to unwrap them so as not to damage them (we are not responsible for damaged caused in this way), to inspect them immediately upon delivery, and notify us by email as soon as possible (and in any event not later than ten working days of receipt) if the goods are damaged or do not otherwise comply with your order, giving full particulars.  In such circumstances we reserve the right to require the return of the goods in the original packing at our expense (by subsequent reimbursement to you following receipt of them) and in the appropriate circumstances then offer to replace the goods or return your money plus the postage in making the return.  Kits are non-returnable unless un-opened in original packaging.

Warrenty and Exclusion:  Subject to our remarks in the preceeding paragraph Beads By Lili warrant that our goods are of merchantable quality.  However, save as precluded by Law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or good will) howsoever arising out of any problem in connection with the goods (whether notified to us or not) and we shall have no liability to pay any money to you by way of compensation other than to refund you the amount paid by you for the goods in question.  In the case of sales outside the UK it is your responsibility  to comply with applicable laws and legislation including the payment of all necessary Customs Duties, Import or other permits to purchase goods from our site.  We make no representation and accept no liability in respect of the import or export of the goods you purchase.  Notwithstanding the foregoing, nothing in these Terms & Conditions is intended to limit any rights you might have as a consumer under applicable Law or other statutory rights that may not be excluded, nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

Please accept this warning that beads or similar goods pose a risk of choking or allergic reaction, should not be put in the mouth and should be kept away from babies & children.  The bead release dust from lampwork beads be rinsed out with tepid water.

Returns & Cancellations:  The Consumer Protection (Distance Selling) Regulations 2000 (as amended from time to time) apply to this contract.  You may cancel your contract with us for the goods you order at any time up to the end of the seventh working day from the date you receive the ordered goods.  You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty.  To cancel your contract you must notify us by email and then confirm in writing by post.  If you have received the goods before you cancel the contract you must send the goods back to our contract address at your own cost & risk.  If you cancel your contract but we have already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us at our contact address at your own cost and risk as soon as possible.  Once you have notified us that you are cancelling your contract and providing the goods are returned by you and received by us in the condition they were when delivered to you, we will refund your money (either by re-crediting your paypal account or by any other method we choose).  If you do not return the goods delivered to you or do not pay the costs of  delivery,  we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.  We also reserve the right to cancel the contract between us if: we have insufficient stock to deliver the goods you have ordered, or we do not (or decide not to) deliver to your area, or one or more of the goods you ordered was listed at an incorrect price due to a typographical error and other pricing information error.  If we do cancel the contract we will notify you by email and re-credit your account.  We will not be obliged to offer any additional compensation for disappointment suffered.
